Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Aethelgard Horizons ("we", "us", "our"). They apply to your access to and use of our website, dashboard, analytics tools and any related services (together, the "Service").

2. Description of the Service

Aethelgard Horizons provides software tools that monitor digital-asset markets, including Bitcoin and Ethereum, and display analytics, risk-management indicators and illustrative calculations. The Service is informational. Unless expressly stated otherwise, we do not hold client funds, do not custody digital assets on your behalf and do not execute transactions for you.

3. Eligibility

You must be at least 18 years old and have legal capacity to enter into a binding contract under the laws of Australia or another applicable jurisdiction. If you use the Service on behalf of an organisation, you warrant that you are authorised to bind that organisation to these Terms.

4. Accounts and Security

Where access requires registration, you must provide accurate and current information and keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorised access. We may suspend or close accounts that we reasonably believe have been compromised or are used in breach of these Terms.

5. No Financial Product Advice

Nothing on the Service constitutes personal financial product advice, a recommendation to buy, sell or hold any asset, or a offer to deal in any financial product. Outputs generated by automated models are not guarantees of future performance. You are solely responsible for your investment decisions and should obtain independent advice from a licensed professional where appropriate.

6. Risk Acknowledgement

Trading and investing in crypto-assets involves a high degree of risk, including the possible total loss of capital. Our Risk Disclosure forms part of these Terms and should be read in full before you rely on any information provided through the Service.

7. Fees

Certain features may be offered for a fee. Where fees apply, they will be disclosed before you commit to a purchase. Prices are quoted in Australian dollars unless otherwise stated and may include or exclude GST as indicated at checkout. We may change fees on reasonable notice, and changes will not apply retrospectively to paid periods.

8. Acceptable Use

You agree not to:

• interfere with, disrupt or attempt to gain unauthorised access to the Service or its underlying systems;
• scrape, copy or redistribute content or data from the Service except as permitted in writing;
• use the Service for money laundering, market manipulation, fraud or any other unlawful activity;
• reverse engineer or attempt to extract the source code or models that power the Service.

9. Intellectual Property

The Service, including its software, design, trademarks (including the Aethelgard Horizons name and logo) and content, is owned by us or our licensors and is protected by Australian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal or internal business purposes in accordance with these Terms.

10. Third-Party Services

The Service may rely on or link to third-party data providers, exchanges, wallets and websites. We do not control and are not responsible for third-party content, availability or conduct. Your dealings with third parties are governed by their own terms.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available". Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where such a guarantee applies and the failure is not trivial, our liability is limited, at our option, to re-supplying the Service or paying the cost of having it re-supplied. Otherwise, our aggregate liability is limited to the fees you paid to us in the twelve months preceding the claim.

12. Indemnity

You agree to indemnify and hold harmless Aethelgard Horizons, its officers, employees and contractors from claims, losses and expenses arising from your breach of these Terms or your unlawful use of the Service.

13. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law or if we reasonably believe continued access creates legal or security risk. Clauses that by their nature should survive termination, including those on intellectual property, disclaimers, liability and governing law, will survive.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email at least 14 days before they take effect, except where a shorter period is required for legal or security reasons. Continued use after the effective date constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State and of the Commonwealth of Australia.
